Terms of Engagement

1. Overview & Scope

Future Care Global is a licensed recruitment and executive search consultancy operating from Azadpur, North Delhi, Delhi 110033. By engaging our recruitment solutions, submitting curriculum vitae (resumes), or executing a corporate recruitment service level agreement (SLA), all parties agree to abide by these Terms of Engagement.

These terms apply to permanent recruitment, executive search, contract staffing, and candidate placement services delivered across Delhi, Noida, Gurgaon, Faridabad, Ghaziabad, and pan-India.

2. Candidate Zero-Fee Commitment

• Candidates agree that all biographical, academic, and professional details provided on their resumes are truthful, accurate, and up-to-date.
• Submission of a CV grants Future Care Global authorization to represent the candidate for suitable vacancies and present their credentials to prospective corporate employers upon consent.
• Candidates may withdraw their candidacy at any stage before formal offer acceptance without financial penalty.

3. Employer Hiring Mandates

When an employer registers a vacancy or requests staffing support from Future Care Global:

• Job Description Specification: The client will furnish a clear job description (JD) including role responsibilities, educational requirements, reporting hierarchy, work location, and proposed salary bandwidth.
• Screening & Shortlisting: Future Care Global screens candidate profiles, verifies experience thresholds, conducts preliminary interviews, and submits curated profiles within 24–48 hours for fast-track roles.
• Interview Feedback: Client employers agree to furnish interview feedback within 3 business days of candidate evaluation to maintain candidate engagement and recruitment momentum.

4. 90-Day Free Replacement Guarantee

To safeguard corporate hiring investments, Future Care Global provides a standard 90-Day Free Replacement Guarantee for all permanent placements:

The replacement guarantee is valid provided that all invoice payments have been settled as per agreed credit terms, and the candidate departure is due to performance failure or voluntary resignation, excluding corporate layoffs, role redundancy, or workplace relocation.

5. Candidate Ownership & Representation Period

When Future Care Global submits a candidate's resume to a client employer via email, WhatsApp, or applicant portal:

• The candidate remains exclusively associated with Future Care Global for that client for a period of twelve (12) months from the date of profile submission.
• If the client hires the introduced candidate in any division, subsidiary, or affiliate within this 12-month period, standard placement fees shall be payable to Future Care Global.

6. Non-Circumvention & Direct Hiring Protection

Clients agree not to bypass, solicit, or directly engage candidates introduced by Future Care Global without acknowledging our introductory mandate. Any attempt to solicit introduced candidates directly to avoid agency remuneration constitutes a breach of contract, subjecting the client to full commercial compensation and legal costs.

7. Invoicing & Commercial Terms

• Consultancy fees are calculated as an agreed percentage of the candidate's Annual Gross Cost to Company (CTC) as specified in the individual client contract agreement.
• Invoices are issued on or immediately after the candidate's formal date of joining.
• Standard payment credit terms are 15 to 30 calendar days from the invoice date, unless explicitly agreed otherwise in a signed Master Services Agreement (MSA).
• Applicable GST (Goods & Services Tax) will be levied on all commercial invoices in accordance with Government of India regulations.

8. Disclaimers & Limitation of Liability

While Future Care Global conducts thorough preliminary interviews and credential validation, the final hiring decision, employment agreement, background check, and compensation package remain the sole discretion and responsibility of the client employer.

Future Care Global shall not be liable for any indirect, punitive, or consequential damages resulting from a candidate's subsequent acts, omissions, or employment conduct once onboarded by the client.

9. Governing Law & Delhi Jurisdiction

These Terms of Engagement and any disputes arising out of recruitment services provided by Future Care Global shall be governed by and construed in accordance with the laws of India.

The competent courts located in Delhi, India shall have exclusive jurisdiction over any legal proceedings or arbitration arising from these terms.
